Research On The Service Invention Reward System

With the advent of knowledge economy era,the level of science and technology innovation becomes more and more important.Service invention-the representative of the power of scientific and technological innovation has become the constraint of national economic growth and the key factor to enhance the comprehensive national strength level.Service invention reward system is the most important part of the service invention system.If the reward system is not perfect,it will make employees lack of creativity,thereby block the innovation pace of enterprise which restricts the increase of overall level of national science and technology.Therefore improve our service invention reward system is particularly important.According to the current legislative situation of China,if we want to achieve this goal,we should adopt measures in the following aspects: firstly,in order to motivate service invention we should solve reward problem of service invention and define the interests of the inventor through legislation;secondly,to determine the standardization of rewards and reasonable reward payment procedure;finally,we should complete the remedy method for inventors.In this paper,except the introduction and conclusion,it is divided into four chapters: in the first chapter,I introduce the connotation of the invention and the invention returns,the nature of the relevant legislation of service invention reward system in our country,the necessity of service invention and briefly reviewed the history of the development of the service invention system;in the second chapter,I describe the implementation of the present situation of our service invention reward system,in-depth analysis of our service invention reward system problems in practice.Specific discussion are focused on the following aspects: to solve from the law applicable standards are not unified,unreasonable allocation of the burden of proof,limitation of action is not clearly defined,reward payment system is not perfect;in the third chapter,I summed up some useful experiences to improve our service invention award pay system through the comparison of several typical service invention reward legislation in some countries,and put forward further ideas.In the fourth chapter,I put forward some suggestions on improving the service invention reward system from the perspective of "the invention of the bill(Draft)",including the applicable standards,strict legal rational allocation of the burden of proof,limitation of action to improve the unified judgment,reward payment system,construction of multiple relief measures.
