Study On The Custom Implementation Mean Of Law Effect

Our country and the folk culture have a long history,so the customs play a huge role in adjusting social relations.The consistency of law and custom profoundly affects the effect of law.Custom implementation mean of law effect is an important way which law obtains efficacy.The customs means what to the efficacy of law,and how the custom implementation mean of law effect works,and how to obtain more efficacy in the custom implementation mean? Obtains the efficacy of law is a dynamic and realistic process,and I try to make further explorations about the custom implementation mean of law effect on the basis of the previous empirical studies.There are important theoretical meaning and realistic meaning to study on the custom implementation mean of law effect.From this study,we can improve the theory of legal system,supplement contents of legal theory,enhance the legal consciousness of the public,improve the social order,reduce the judicial cost,and realize the law effect.Study on it is significant to promote Chinese legal construction.This paper consists of five parts: introduction,the general exposition of the custom implementation mean of law effect,the reasons why the custom implementation mean is one kind of the means of efficacy of law,the custom implementation mean of law effect's work modes,the countermeasures of improving law effect under the custom implementation mean.The first part is introduction.This part introduces the reason why I chose this topic,analyzes the research significance about the custom mean of law effect from theory aspect and reality aspect.The second part is the general exposition of the custom mean of law effect.First,this paper starts from discussing efficacy of law to expound the efficacy of law's concept,characteristics,and make compare with relevant concepts.Then,this paper explains the concept and characteristics of customs.Finally,this paper explains the concept of the custom implementation mean of law effect and this part analysis the influence factors to the custom implementation mean of law effect between the role of customs and the efficacy of law on the basics of what is said above.The third part is the reasons why the custom mean is one kind of the means of efficacy of law and the influence factors to the custom implementation mean of law effect.This part uses the method of dialectical analysis.And this part starts from the function of customs and the significance of customs to the efficacy of law to complain the reasons why the custom mean is one kind of the means of efficacy of law.The fourth part is the custom mean of law effect's work modes.This part discusses the reasons why people accept customs to comply with the law.The fifth part is the countermeasures of improving law effect under the custom implementation mean.This part discusses how to improve law effect from legislation,judicial,law enforcement,law-abiding four ways..
