Astudy On The Legal Responsibility Of Personal Injury Compensation In Sports Reality Show In China

With the 2016 Olympic year to start,combined with Beijing and Zhangjiakou won the 2022 Olympic Games host the right,the big TV scrambling to catch the Olympic year of the ride,have launched or are still preparing a "sports reality show program." The rapid development of China's sports reality show is obvious to all,from 2008 to meet the Beijing Olympic Games launched by the general public to participate in the sports class variety to the sports entertainment stars to participate in today's competitive sports reality show,its competitiveness can be imagined The Due to the physical fitness of the participating people and the lack of understanding of sports skills and other external environmental factors in the process of participation will inevitably appear personal injury accident.This paper studies the legal liability of personal injury compensation in China's sports reality show,which is beneficial to obtain more benefits for the production unit and the participating staff when the infringement occurs.This paper will start from the present situation of personal injury compensation in China 's sports reality show,and use the method of literature,logic analysis,case analysis and expert interview to summarize the main body of personal injury liability and its legal relationship in China' s sports reality show.This paper analyzes the scope of personal injury in the sports reality show in China,and then studies the attribution and application of personal injury compensation in China's sports reality show.Finally,it summarizes the compensation standard of personal injury in China's sports reality show.Through the above study,the following conclusions are drawn: First,the legal relationship between the participants in the personal injury compensation and the main unit of the production unit is the equal contractual relationship;Second,the existence of the fault of both the main body of the situation,or there is a subject of the existence of fault,should follow the principle of fault liability;Third,the production process of the program,whether it is not human behavior caused by the damage results,have the responsibility to compensate,should follow the principle of no fault liability;Fourthly,the compensation for personal injury in the sports reality show is not equal to the benefit of the interests between the production unit and the participating staff;Fifthly,the introduction of the principle of risk self-agility in the sports reality show in China should be clear and the emphasis should be on the "voluntary" principle,and the scope of application of the principle of risk should be strictly limited to prevent the abuse of the principle.
