On Protecting Rights Of Criminal Suspects In Our Country During The Investigation Stage

As the initial and inevitable period of a criminal case,the investigation stage determines the proceeding of the following procedures to a large extent and even influences the fate of criminal suspects.With the growing international concerns about the issue of human rights,our country has included the protection of human rights into the constitution,which shows the equal importance of the protection of human rights and the fight against crime.The protection of private rights and public rights can coexist peacefully.How to protect the legitimate rights and interests of criminal suspects effectively has always been a significant subject in the law field.Although the protection of criminal suspects' human rights has made breakthrough in our country,compared with other developed countries ruled of laws and international standards,some contents that criminal suspects' human rights protection in the detection stage still need to be improved.This paper starts from the concept of criminal suspects' human rights protection in the detection stage,studies the provisions on criminal suspects' rights during the investigation stage in the Criminal Procedure Law and relevant provisions in foreign laws,and analyzes the improvements and deficiencies of criminal suspects' human rights protection in the detection stage in the current Criminal Procedure Law.Related suggestions are proposed to benefit the construction of criminal suspects' rights protection institution in criminal proceedings,reduce the occurrence of injustices,promote the harmony and development of society,improve the level of human rights' construction.
