Research On The Light Punishment Into Malpractice And Infringement Cases Faced By The Basic Level Procuratorate

In recent years,Light-duty malfeasance crime problem more and more prominent in our country which was become a problem of common society.Malfeasance crime prison rate is low,sentenced to exempt from punishment and sentencing generally low tendency of light punishment does not accord with the development trend in contemporary criminal law seriously,and run counter to China's current anti-corruption,damage to the broad masses of the people's anti-corruption enthusiasm,damage the credibility of judicial organs.Malfeasance crime sentencing light punishment phenomenon has caused the party and the country attaches great importance to,in order to find the social impact of malfeasance crime light punishment,causes and countermeasures,all the procuratorial organs researching on it several times,but at present there is no authoritative research conclusion,the problem has not been meaningful to solve.So the subject in this paper that is the light-duty phenomenon of malfeasance crime of grass-roots procuratorate in our country,closely with judicial principle and handling practice which as example in the author's basic procuratorate malfeasance cases to analyzing,summarying the characteristics and the regular of the light-duty malfeasance crime,analyzes the harm and cause,and then from the perspectives of legislative,judicial,puts forward the thinking and countermeasures to solve these problems,strive to providing some reference and enlightenment to solve the grass-roots procuratorate malfeasance crime of infringement light problems.This thesis is divided into five parts,the first part introduce the selected topic background and significance;The second part introduces the connotation of the light-duty malfeasance crime and academic point of view;The third part for example in the author's a grassroots people's procuratorate at M city of guangdong province,summarying the characteristics?forms and harm of light-duty malpractice tort crime in China;The fourth part analyzes the reasons of the existence of the light-duty malfeasance crime in our country at present.The fifth part is putting forward from the aspects of legislation and judicial practice feasible countermeasures for Light-duty malfeasance crime of infringement of grass-roots procuratorate in our country.
