With the development of cities,urban road has become scarce resources.The increases in population and number of vehicles have caused serious traffic congestion.In this context,in order to ease traffic jams,the State Council issued " Opinions on Further Strengthening of Urban Planning and Construction Management " to implement open block policy,requiring to open the community gradually and publicize the internal road.The future development of China's big cities will probably follow this policy.However,the biggest problem of this policy is how to deal with the rights of the community owners,not the effective of the policy.If open the original closed community,the owners' rights of property must be damaged,which is why this policy be widely argued.In this paper,the reasonableness analysis on open block policy is from the perspective of Law and Economics and focuses on combing the theoretical basis and clearly putting forward the theoretical framework of analysis.This paper hopes to provide theoretical basis for policy implementation and legislation.Finally,the theoretical basis of this article is also applicable to the policy of "Limit Pass","Limit License" and land expropriation.This paper discusses the issue from three aspects:The first part is from chapter one and two.It mainly elaborates the background,literature review and the concept of open block policy,helping to explain the practical significance and clear the scope of the problem.The second part is from chapter three.By combing the theoretical point of Law and Economics,the paper discusses the theoretical basis of open block policy.The third part is from chapter four.By summarizing the theory of Law and Economics,the paper discusses the theoretical framework of analysis and specific analysis the reasonableness on open block policy.
