Organized crime is violent,cruel,permeability and erosion,not only severely disrupted the social life and economic order,but also seriously undermined the country's political stability.Since the 1980 s,through the "formation,rapid growth,high end" three stages of rapid development,organized crime has formed a new stage that high-risk special crime blend coexist,"the east serious and the west moderate,the south frequent and the north less".And the organized crime often combines with prostitution,gambling,drug,gun and other special crimes.At the same time,the form of criminal organization began to legalize,the profit patterns began to diversified trend,the rate of vicious power crime is higher,and the criminal means show other new features and trends,for example "soft violence" and the severity of corruption.This is the masses of security and social order to form a serious harm and impact,become the focus of public security organs to combat targets.However,in the perspective of criminal investigation,analysis of practice to crack down on organized crime,found the investigation organ faces many difficulties in the process of fighting crime,such as: clues are found difficultly,core members find out and collect witness' s testimony,the criminal suspect difficult trial breakthrough and so on.The main reason is that investigation organ lacks professional combat team;and the information collection work is lagging behind;lack of depth of the study of the case,multi-sectoral joint combat mechanism is not perfect,witness protection system is not safe,the main rights and interests protection is incomplete and many other factors.Based on the investigation and the external cause of system analysis,combined with the current trend of reform of the judicial and public security,and rationally using the mature experience in case of outside.The author thinks that it is necessary to build a special investigation team to crack the detection,implement the responsibility system for the handling system,pay more attention to protect the informers and witnesseswidely develop intelligence collection channels,and strengthen the criminal information,case analysis,explore the organized crime within the jurisdiction of a risk assessment.Therefore,need to carry out investigation depth,omni-directional grasp the investigation of the situation,the initiative control of investigation.Accurately grasp the interrogation breakthrough,try to introduce the trial system in order to reduce the difficulty of evidence collection and the risk of illegal evidence collection.And improve the mechanism of the organized crime investigation,create more departments jointly probing mechanism.At the same time,we need start from the heightof the trial center doctrine,from the legal norms,protection agency,aspects such as strengthening the protection of the witness protection program,increase the rate of witness to testify.Only take a variety of measures,can improve the fight against organized crime theory,enhance the detection ability of fighting organized crime.
