Research On The Investigation Countermeasures Of Bid-rigging Crime In The Construction Field

With the rapid development of China's economy and continuous expansion of investment in the engineering construction industry,the phenomenon of bid-rigging crime has become increasingly worse because of multiple reasons such as participants' being driven by huge economic profit,tenderers' negligence of bidder qualification examination,imperfect supervision system of the construction market and incomplete legal system.The construction market is also plagued with many problems,like the rampant phenomenon of qualification certificates being lent or affiliated to under qualified companies,easyconcealment and low incidence of criminal cases,diversifiedand collectivized criminal subjects and growing duty crime,which make the police facing greater challenges in getting relevant clues,fighting against criminals and recording the suspects' confession while handling such cases.Bid-rigging crimein the construction field has not only disrupted the market competition order and damaged the interests of tenderers and bidders,but also made it difficult to guarantee construction quality because of the bad quality projects resulted from bid-rigging crime.Hence,it is necessary to studybid-rigging crime and put forward effective investigation measures.The paper analyzes the investigation measures againstbid-rigging crimein theconstruction field through four parts.The first part gives a general introduction of tenderers and bidders in the engineering construction industry,including their basic concepts,operation processes and evaluation methods.The second part sums upthecriminal cases of bid-rigging crime,which mainly discusses its caseidentification,characteristics and causes.The third part introduces three means of committing such criminal cases which are collusion between tenderers and bidders,collusion among bidders,and collusion between bidding agencies and tenderers/bidders,and analyzes the characteristics of each different means,which helps expose new features,patterns and trends of such crime.The last part puts forward the investigation measures for dealing with bid-rigging crime in the construction field,including methods for clue collection,specific investigation ways tosolvesuchcriminal cases,ways to improve evidence chains,measures to enhance the internal and external coordination and so on.
