A Study On The Legal Problems Of Corporate Governance Structure Of Farmers' Specialized Cooperatives In China

In recent years,the central and local governments have combined farmer cooperatives with poverty alleviation policies such as "Precise Poverty Alleviation" and "Agrarian Reform",etc.,injecting poverty relief funds into cooperatives,breaking the barrier of rural land use rights.Farmers as investors and other measures to promote the healthy and orderly development of farmer professional cooperatives.Liupanshui city government is in this context,in response to the central call,according to local conditions put forward the rural "three change" reform program.Three years after the implementation of the program has made remarkable achievements,greatly improving the living conditions of local rural poor.In this paper,Liupanshui Farmer Cooperative is the main research object.Through the field research,theoretical research,and other means of profound analysis of the professional bodies of farmers cooperatives,corporate governance structure of its characteristics,the current problems and improve the way to do a detailed explanation.The purpose of this paper is to provide feasible suggestions for improving the present situation of corporate governance structure of peasant cooperatives and orderly development of cooperatives.I use the traditional "problem-cause-countermeasure" syllogism writing style,theoretical analysis throughout the article has always been,but also with the appropriate data analysis,the article argues that rich,well-founded.The article mainly has three parts: 1,the first chapter explains the theoretical basis of the legal structure of the legal cooperation of farmers.The second chapter analyzes the problems existing in the corporate governance structure of the farmers' professional cooperatives in Liupanshui City,which is mainly based on the results of statistical analysis of data such as the data of "Reform of Three Changes" in Liupanshui City and 30 farmers' professional cooperatives.3,the third chapter is mainly based on the second chapter of the development of cooperatives on the basis of the problem,from the farmer professional cooperatives corporate governance structure mechanism,the main body of the cooperative management system,Rules system and fund channel to explore the perfect proposal: perfect the corporate governance mechanism of cooperatives,establish decision-making,implement and supervise the system of "separation of powers";perfect the legal system of farmer's professional cooperatives,establish the fund collection system and management Management incentive mechanism,the establishment of cooperatives in the cooperative law system,improve the ability of cooperatives to resist risks;expand the co-financing sources of funds to break the development of cooperatives facing the financial difficulties.
