Research On The System Of Safeguard Measures Of Free Trade Agreement

The free trade zone as the main representative of the regional trade arrangements has gradually emerged in recent years,many countries are actively negotiating the establishment of free trade zones.While the free trade zone is developing rapidly,the safeguard measures in trade remedy measures are especially important for all countries.On the basis of defining the concept of safeguard measures in free trade agreements,it clarifies its implementation conditions and types and analyzes the necessity of safeguard measures system.NAFTA as a model of the free trade zone,in which the provisions on the safeguards system is more mature;"EU-Canada Free Trade Agreement" and TPP on the safeguards system also has a certain representation.It is of great significance to perfect the safeguard system in China's free trade agreement by drawing on the useful experience of the safeguard system in the above-mentioned free trade agreement.By analyzing the status of the safeguard measures system in China's signed free trade agreements,the following main problems are summarized: the lack of flexibility in the application of global safeguards,the lack of implementation conditions and implementation procedures;the transitional period and the long implementation period of bilateral safeguard measures;The dispute settlement mechanism needs to be improved.In this regard,we should make flexible use of global safeguards,such as the provision of double trade remedy,the appropriate exclusion of the application of global safeguards,improve its implementation conditions and procedures;refine the implementation of bilateral safeguards conditions,appropriate shorten the transition period and implementation period;Early warning mechanism,perfect dispute settlement mechanism and remedy means.
