In recent years,with the rapid development of China’s social,economic and international trade,the popularity of Internet and electronic technology,smuggling crime presents new features,smuggling crime overall upward trend,anti-smuggling work situation is very grim.General Administration of Customs has always been to combat smuggling crime in high pressure situation,and actively carry out combat smuggling action,and achieved fruitful results.However,in the actual investigation of smuggling crime cases,there are many difficulties in the investigation and evidence collection work,which hinders the smooth progress of smuggling crime investigation work.In Tianjin area as an example,this article through to the Tianjin customs anti-smuggling bureau of investigation evidence collection work actual situation,the smuggling crime cases in Tianjin,and Tianjin customs anti-smuggling bureau of investigation evidence collection of opinions and Suggestions to carry on the analysis,the author comprehensively thoroughly to deal with the difficulty of smuggling crimes investigation evidence collection work and the reasons,and put forward effective countermeasures and Suggestions.This paper is divided into four parts.The first part is an overview of smuggling crime investigation and evidence collection,briefly introduces the concept,current situation and harm of smuggling crime,and expounds the meaning,requirement and particularity of smuggling evidence.The second part mainly starts from the four lines of investigation and evidence collection of smuggling crime: the subjective intention,the chain of documents,the chain of funds,the chain of goods,the form of evidence,the way of obtaining and the difficulty of obtaining,and the brief analysis of the case of typical smuggling crime;This paper analyzes the causes of the difficulties in the investigation and evidence collection of smuggling crime,including the specialization of smuggling crime,the concealment of smuggling crime mode,the lack of operational skills of investigation and evidence collection,the lack of smooth cooperation between overseas anti-smuggling department and smuggling crime investigation and evidence collection.The fourth part puts forward the countermeasures to solve the difficulties.Combined with the actual situation of the work of the Customs and Excise Department to investigate and collect evidence,put forward practical measures,including perfecting the legal norms of smuggling crime investigation and evidence collection,perfecting the working mechanism of investigating and collecting evidence,improving the skills ofinvestigating and collecting evidence,playing the anti-Strengthen domestic and foreign anti-smuggling joint law enforcement.
