With the development of economy,the employment way of demand also became more diversified.Labor dispatch as a new employing way quickly spread in our country.In 2008 after the implementation of the "labor contract law" in China,only changed the originally could not be in accordance with the conditions.In July 2013,the implementation of the "labor contract law amendment,a substantial modification for dispatching part,but for the protection of laborer,to implement and there are many.Nowadays,labor dispatching become a hedging tool,it is difficult to guarantee the lawful rights and interests of workers.Based on this,this article in the labor dispatching laborers' legitimate rights and interests protection for topic selection,to improve the system of protection of the rights and interests of labourers were discussed and research.Rights and interests of the dispatched workers in our country the main aspects including the right to equal pay for equal work is difficult to achieve,the occupational safety and power is difficult to guarantee,right of association is not maintained,"false outsourcing,true to send" flood and training right,right to know and stable professional rights protected,main causes include a heavy current legal relationship of position is not reasonable,protection of the rights and interests of the dispatched workers the lack of specific legal norms,dispatching units and the legal responsibility of the unit that use worker worker distribution is unknown,the dispatched workers rights relief mechanism is not perfect and dispatch regulation.Labor dispatching in China to confirm the necessity of the dual labor relations lies in the fact that is the inevitable requirement to realize the dispatched laborer equal pay for equal work,is to determine the inevitable requirement of unit of choose and employ persons and joint and several liability of the unit that use worker worker,and is the necessary request to improve the system of labor dispatch.We should confirm the dual labor relations through legislation,perfecting the protection of the rights and interests of dispatched laborers of the detailed specification,clear dispatch units and employment units employer responsibility allocation,improve the dispatched laborers rights relief mechanism,establish long-term effective mechanism of dispatching supervision.Through for the perfection of labor dispatch legislation regulation,strengthening enforcement,sound regulatory measures to earnestly safeguard the legitimate rights and interests of the dispatched workers,arouse their working enthusiasm,combines laborer individual value and enterprise development is very good,eventually as awhole to promote the healthy development of labor dispatching labor way.
