Reflection And Improvement Of Dispute Settlement Mechanism Of Housing Accumulation Fund

Since the housing accumulation fund system has been running for more than 20 years,more and more disputes on the deposit and management of the fund have taken place among employees,employers and the management center.In view of the existing regulations,there are many problems such as the weakness of administrative relief and lack of judicial relief in the dispute settlement mechanism.Some of drawbacks of the system design result in the lack of rigidity of mandatory deposit obligation,lack of operability of the administrative law enforcement and lack of legal basis for workers to seek judicial relief.Inadequate supply of the system,the interests of all parties to the game and the inertia of the original resolution of the dispute led to the plight of the current dispute settlement.Based on the legal nature of social welfare and system orientation of housing security of the housing accumulation fund,some suggestions are put forward on the improvement of the dispute settlement mechanism,such as increasing the intensity of administrative relief,opening up the way of judicial relief,strengthening the government’s responsibility in the protection of the rights and interests of workers and raising the legislative level of housing provident fund.
