Study On Legal Issues Of Housing Public Accumulation Fund In China

According to "the rule of housing public accumulation fund", housing public accumulation fund is a long-term housing lodgment which is paid by government, state-owned enterprises, institutions, institutions managed by people, social groups and all the working employees. Housing public accumulation fund is a very important element in the process of housing system reform. Virtually the housing public accumulation fund is an indemnificatory fond which is one part of working payment, belongs to all the individuals and is particularly used to resort housing problems of workers.There has been an economic reform directed to marketability after the year 1978. This made problems of the original housing safeguard system which suited to the planned economy explored totally. In April 1999, the state council promulgated and implemented "the rule of housing public accumulation fond" which represented the management of housing public accumulation fond turned to be standardized and legalized. After the development for more than ten years, housing public accumulation fond has been established gradually in the whole country and at present it is a crucial component of social security system. But there are still many flaws of the legal system of housing public accumulation fond for such a short history, such as the nature of the fond is not defied clearly, the power of regulatory agency of the fond is not explicit, there is just one kind of the interest rate and it is used by low efficiency, the group of beneficiary is quite small and the rights of those people who are with low-income are not protected well. All of these problems of the housing public accumulation fond need to be solved and the system itself needs to be perfected.Based on the background introduced above, this dissertation makes use of essential principles of economic law, analyzes the basic situation of existing housing public accumulation fond, gives a reference to successful experience of several foreign countries and finally gives some suggestions. Existing research achievements are the foundation of this dissertation. Absorbing the accomplishments, the dissertation tries to innovate in some areas at the same time. First of all, the dissertation casts back the background of establishment of the legal system and some significant milestones then compares the system with some relevant ones in foreign countries in details, presents the objectivity and necessity of the housing public accumulation fund. Secondly, the dissertation makes efforts to build a reasonable legal system of housing public accumulation fund. The system which meets the reality of our country should be the one which could satisfy all the individuals in the market economy. It should be a comprehensive one with all the necessary components and a complete frame. In addition, the dissertation makes analyses on some issues from theoretical angel, such as the interest rate, beneficiary and so on.This dissertation searches for path of development of the legal system of housing public accumulation fund with the purpose of providing guarantee for the implementation and reference for the legislation.
