When the Criminal Procedure Law of the People's Republic of China was amended in 2012,the whole process of synchronous recording and video recording of the interrogation was clearly defined in law.This shows that the concept of human rights protection in China has entered a new historical stage.Investigative interrogation synchronized audio and video recording system is a concrete manifestation of the concept of human rights protection in the criminal judicial procedure,the system is not only conducive to respect and safeguard human rights,standardize judicial procedure,but also conducive to the fight against crime,improve work efficiency.In recent years,procuratorial organs and public security organs and discipline inspection departments carried out interrogation synchronized audio and video recording system,through the analysis of China's interrogation synchronized audio and video recording system for operation of the actual situation,we can see that the system in operation of our country's judicial practice there are still many problems,Both ideological problems such as lack of awareness,the investigators of the system of criminal suspects psychological resistance to audio and video,there are specific implementation issues such as audio and video work is not active,two record is not full,recorded in the trial separation operation problems and so on.The causes of the problems are the lack of legal provisions,lack of human property,inadequate supervision mechanism and so on.Through the analysis and comparison of interrogation recording system abroad and related area are different,and reference suitable for our country judicial regulations and judicial practice,finally puts forward more perfect interrogation synchronized audio and video advice,It includes:standardizing the legal nature of audio and video recording,standardizing the operation process of recording and video recording,standardizing the main body of recording and video recording,standardizing the editing and keeping of audio and video recordings,and standardizing the supervision mechanism of recording and video recording,etc..Nevertheless,the audio and video recording system of investigation and interrogation needs to be further studied in the future.
