Research On The System Of Sychronous Audio And Video Recording Of Interrogation Under The New Law

Ariticle121of the new criminal procedure law stipulates the system ofsynchronous audio and video recording of interrogation. It’s the first time toclearly define the law status that the system of synchronous audio and videorecording of interrogation is applied to judical practice, changing the currentsituation that the former system of synchronous audio and video recording ofinterrogation was only interpreted with justice. However, the stipulation ofthe new law about this system is too simple and concrete operationprocedures have not been prescribed in detail. Moreover, from thecomparison law, the system of synchronous audio and video recording ofinterrogation in China is incomplete and the problems existing in the formerlaw system such as dispute over the evidence of the system of synchronous audio and video recording of interrogation, the criminal’s option andapproval rights, processing of defect synchronous audio and video recordingof interrogation and supervision of it have not been solved. Therefore, thesystem of synchronous audio and video recording of interrogation still needsto be perfected under the background of the new criminal procedure law.
