On Synchronous Audio And Video Recording System Of Investigation And Interrogation Before Custody

The establishment of synchronous audio and video recording system for investigation and interrogation is an institutional measure to protect the rights of criminal suspects under the background of human rights protection.However,China's criminal procedure law does not make clear provisions on whether the investigation interrogation before custody should be conducted with audio and video recording and the legal attributes of interrogation.Therefore,this brings many problems to judicial practice.This paper mainly takes the investigation interrogation before custody as the research object,and adopts the methods of literature analysis,empirical research and comparative analysis to explore the practical difficulties and solutions of the synchronous audio and video recording system of investigation interrogation before custody in this stage.First,the theoretical support of the existence of the system,including the legal basis and practical value of the system;Second,based on the related theory of scholars both at home and abroad to study,and the author X city in Jiangsu province some investigation department custody before their interrogation practice how to implement the synchronized video recording system is investigated,according to legal provisions and reference,understanding to the current state of the system,and a comparative analysis of the system in the practical difficulties encountered in practice,etc.;Thirdly,combined with the theory and practice,this paper explores the reasons for the predicament of the recording and video system of investigation and interrogation before custody in China,and tries to seek for the remedy of problems in an exploratory way,so as to find the countermeasures to solve the problems.The original intention of setting up the system is to protect the rights of criminal suspects.
