The Basic Relationship Of Avoidance

The avoidance system in judicial practice is a very important basic system to ensure the rights of the parties and the impartiality of the trial results.Judges should be circumvented when there is a law that may affect the fair judgment of the case.Based on the current Civil Procedure Law,it is necessary to analyze the avoidance system and maintain the neutrality of the trial activities from the perspective of human relations.Based on the basic types of human relations,this paper explores the influence of human relations on human behavior by using the method of legal hermeneutics,the method of comparative study and the method of empirical analysis,and explores human relations by the partial behavior of human behavior and finds out the relationship between the avoidance system basis.This paper studies the relationship between the system of evasion and avoidance in the current Civil Procedure Law of our country from the four aspects of kinship,interest,affective relationship and other relations,and puts forward the improvement plan of legislation from the perspective of the relationship.
