The Jurisprudential Analysis Of The Internet Privacy Right And Its Legal Protection

The flow of information is not smooth in traditional society,so the protection of personal privacy is not a prominent problem.However,since entering the internet era,with the extensive application and rapid development of the technology,the speed of information dissemination is getting faster,which makes the internet privacy of citizens' has been unprecedentedly threated.Therefore,it is necessary to deepen the relevant legal theory research on the internet privacy right and explore China how to establish the corresponding system of internet privacy protection.The author' analysis and discussion on this research topic mainly arounds the following aspects: Firstly,the related theories of internet privacy is overall summarized.On the one hand,it defines the term "privacy" from the semantics,then further clarifies the concept of the privacy right,the concept and features of the internet privacy right.On the other hand,it points out the value and significance of strengthening the ethical legitimacy and legal protection of citizens' privacy protection under the network environment.Secondly,the realistic dilemma and reasons of the internet privacy protection is analyzed.It is necessary not only to know a variety of performance of China's internet privacy protection dilemma through the specific cases,but also to analyze the causes of the internet privacy protection dilemma from the technical level,the consciousness level and the system level.Thirdly,it mainly uses the method of comparative law to study the modes of privacy protection of foreign countries and regions in the network environment.The author mainly focuses on the analysis of the America's industry self-discipline protection model and the EU's legislative protection model,and makes some commentaries on several kinds of internet privacy protection modes.Finally,it analyzes the status quo and difficulties of the protection of internet privacy in China and puts forward the suggestions of perfecting the protection of the internet privacy in China.China should make effort to better protect citizens' internet privacy from the aspects of legislation,law enforcement,judicial guarantee,industry self-discipline and technical support.
