The Research On Public Of The Personal Security Interest

The secured transactions in economic trading parties seek financing needs,and will not make it lost the right to use of the mortgaged property income,therefore have been widely used by countries.But because of the movable security interest does not transfer the guarantor’s possession of collateral,easy mobility of movable property is likely to cause defects of secured transactions in the public,thus produced the security interest registration system,it is the key to the secured transactions can play a role of financing.Chinese “Property law”,“the Method of the Security Interest Registration”,“CCRC Movables Financing Registry” and related laws on the system of the security interest registration,but because the theory study of the system is not mature,the current legislation ability is limited,so the maneuverability of the system in China is not practical,cannot should play its role in financing guarantee.This paper first introduces the theory of the security interest registration system,after the study of U.C.C Article-9,comparison on the international typical system,reflect on the lack of system in China,finally put forward the suggestion of perfecting our country’s system of the security interest registration system.This paper is divided into three chapters besides the introduction:The first chapter on the basis of “the method of the security interest registration”,“CCRC Movables Financing Registry” and related laws and regulations,from filling department,registration content,initiator,censorship and registration system five aspects analysis the disadvantages of the current system.The second chapter,by studying U.C.C Article-9,the legal system of the security interest registration system in Taiwan area,and the international common practice,to learn that the system on international development status and trends.The third chapter on the basis of the foregoing contents,from the unified filling department,declaration registration system,unilateral application start up,the form of censorship and the establishment of electronic registration system five aspects put forward suggestions to the existing system in China.
