Right to the contracted management of rural land circulation system in our country there are now market is not mature,the program does not open,farmer rights and interests protection not in place,such problems as lack of supervision,land circulation system compared with the developed countries there is still a big gap.How to establish and improve a set of perfect right to the contracted management of land circulation system,to guide the healthy circulation of rural land legal and orderly,not only can make the farmers benefit,and to maximize the utilization of rural land value,Become an urgent problem urgently need to be determined.view of the practice of farmland transfer in China,rural land transfer legal system should be established from the following five aspects: First,improve the system of land collective ownership and the form of rural collective economic organization;The second is to promote the "agricultural land" system of three-power system,and establish a sound system of land contract right and land management right,standardize the transfer procedures of land management rights and expand the transfer of land management rights.Third,we should establish a unified agricultural land transfer platform,standardize the evaluation mechanism of land management rights,and improve the transfer agency of land management rights.;Fourth,the establishment of the supporting land rights relief mechanism,the judicial relief mechanism should play its due role;Fifth,to improve the rural social security system to remove farmers' transfer of land.
