Luo Longji was a figure active on the political stage during the 1930 s and 1940 s in China.As an independent scholar,he published numerous articles through "New Moon","Independent Review",and "Social Welfare Tientsin".He criticize the KMT authoritarian policies,promote human rights,democracy and the rule of law,call for an end to the civil war,unite all anti-Japanese forces.Later,as a representative of democratic parties,he had took an active part in political practices at that time,and proposed the political plan of "The Third Route".He made great contributions to the building of democracy,Anti-Japanese War,and peaceful state founding for China at that time.Luo Longji's constitutional government thoughts concerns human rights,democracy and rule of law,and each dimension reflects his understanding of constitutional government.Luo's constitutional government theory is based on his human rights theory.His elaboration on constitutional government,democracy,and rule of law is based on his faith in human rights.He creatively put forward that human rights are the prerequisite to be human.The function of law is to guarantee human rights.Human rights exist prior to the law.He also believes that constitutional government is the necessary way to realize democracy,and democracy is the main feature of constitutional government.It is easier to achieve and protect human rights in a democracy.Autocracies can only crushes human rights.The spirit of the rule of law is the guarantee of the implementation of constitutional government.Only by relying on the rule of law can we effectively restrict the power of the government and achieve the purpose of guaranteeing human rights.There are also certain defects in Luo's constitutional government thoughts.For example,his conditioning theory of human rights lacks sufficient logical argumentation.Most contents of his constitutional government thoughts directly introduce the theories of western political philosophy,and lack survey on the reality of Chinese society.His democracy strategy of the third way is aborted due to the weak force of democratic parties and lack of emotional appeal.
