Analysis On Causes And Countermeasures Of Juvenile Gang Delinquency

Due to specific factors such as age,mind,minors in the process of growth are often susceptible to the adverse effects of the surrounding environment,or lured by some undesirable activities,which resulted in crime.At present,the general principle of "education-oriented and punishment-supplemented" is mainly used in the criminal legislation of our country,the treatment of juvenile delinquency by criminal justice is dealt with in a more lenient manner without prosecuting or sentencing,in the context of legislative and judicial tightening that has tended to criminalize the delinquency of minors,the phenomenon of juvenile delinquency in the criminal of our country is still becoming serious.In the juvenile delinquency,gang crime is particularly prominent.The juvenile gang crime is a criminal offence committed by a group of more than three(including three)minors and adults combined.Because of the minors ' own characteristics,it is often difficult to make a single crime,so gang crimes gradually become a major form of juvenile delinquency.At present,the laws and regulations of juvenile delinquency in our country only make provision for its general crime pattern,and the phenomenon of gang crime is hardly mentioned,only the "on the current handling of the group of criminal cases of specific application of the law of some of the answers to the gang crime" jointly issued by the Supreme People's Court,the Supreme People's Procuratorate,the Ministry of Public Security in 1984 mentioned,its legal nature and application of law are all pending discussion.In order to prevent the juvenile gang crime better,protect the minors ' healthy growth and create a safe social environment,the theory research of the juvenile gang crime has become an important precondition.Although early scholars have noted the fact that gangs in juvenile gangs commit more crimes than they do,there are few research achievements,lack in empirical research and disconnection between theory and practice.This paper takes the 2010-2016 Fengcheng of the juvenile gangs in Jiangxi Province as the research perspective,then analyze the criminal judicial data of juvenile gangs in Fengcheng,Jiangxi Province in 2010-2016.The characteristics of juvenile gang crime includes three aspects,such as crime subject,criminal behavior and criminal organization.The first aspect shows three characteristics,concludes the low education level,the crime age centralism and idleness unemployed;in criminal behavior,it shows that the motive of crime is simple,the crime is more than temporary,and the type of crime is mostly property crime.In the case of criminal organizations,there exists a group composed solely of minors,as well as groups of minors and adults,and the majority of the crimes are small and medium-sized groups.Among the causes of juvenile gang crime,including the formation of gangs and the reason of gang crime.Among them,the reasons of gang formation include the need of minors,the need of emotional interaction,the need for coping with pressure and the need of interest;the causes of gang crime include the embodiment of group power,the pursuit of group identity and excessive desire.In the Juvenile gang crime prevention countermeasure aspect,mainly including education prevention,self-adjustment prevention,social protection prevention and legislation prevention.Among them,the education prevention includes family education,school education and social education;self-adjustment prevention includes proper demand,emotional balance,bad behavior and self adjustment of interpersonal relationship;the prevention of social protection includes the establishment of the Minors ' relief organization,the interest appeal mechanism,the Legal aid organization and the juvenile Court;the legislation prevention includes the establishment and perfection of the Basic Law,the basic rights and interests of minors,the judicial protection and other protective laws.
