Article 35 of the Constitution of the People's Republic of China stipulates that "citizens of the People's Republic of China have freedom of speech,publication,assembly,association,procession and demonstration."The right to freedom of expression as a basic right of citizens,with the arrival of the media age,For our citizens to exercise the right to freedom of expression provides a new way.Compared with the traditional media,from the media access threshold is low,anonymity,openness and other characteristics of the freedom of speech to be fully exploited.Since the media as a platform for expression of speech,but also become the public access to information,communication and communication of the main channels.With the advent of the media age,citizens' right to freedom of speech has been unprecedentedly developed,but at the same time,a lot of negative problems are bred.There are numerous problems such as abuse of rights at a certain degree,violations of the legitimate rights of others,interference in judicial independence,the impact of social and public order,etc.Therefore,the legal system of we-media speech must be established as soon as possible to eliminate the negative impacts from the we-media speech,and play a positive role in the we-media speech.At present,there are many legal documents related to media rhetoric under the current legal system of our country.However,there are some shortcomings in these legal documents,which are not so ideal for the legal regulation of media speech.Therefore,the legal documents providing the media speech need to be improved.This article discusses the legal regulation of media speech in five aspects:The first part starts from the ontology of media speech,and firstly study the basic theory from the we-media,including the content of the we-media,the development process,the characteristics and so on.Secondly,it defines the freedom of speech,and elaborate the realistic significance of freedom of speech.The second part mainly analyzes and summarizes the legal regulation of media rhetoric at home and abroad.The third and the fourth part chiefly elaborate the present situation of the development of we-media speech and the problems highlighted in the development process,and analyze the causes of these problems.The fifth part puts forward suggestions to legislation of we-media speech to improve the legal regulation at the fundamental analysis of the above four parts.
