A Study On The Legal Regulation Of Freedom Of Speech In We Media

Freedom of speech is the cornerstone of human freedom,and it helps to promote the development of a country's democratic politics.Many countries in the world have free speech in their constitutions.In the same way,our country has given freedom of expression the legal protection of the constitutional level.At the same time,with the development of media technology,freedom of speech in media has become a new form of citizens ' freedom of speech,that is,within the limits permitted by laws and regulations,citizens can freely produce and publish relevant information from the media,without being hindered by others or public power.It further expands the space for citizens ' freedom of expression and broadens the channels for citizens to participate in state affairs and to monitor the public power of the government.But it is also due to the interaction,fission,anonymity and civilian characteristics of media speech,and also brings many social problems.A large number of media anomie violations of the right to reputation,privacy and so on,as well as violating social morals,disrupting social order and even endangering national security.In order to solve the problems caused by the freedom of speech in the media,our country has promulgated many laws and regulations about the media.However,there are still some problems in the process of legal regulation of freedom of speech in media.Therefore,the article proposes that the freedom of speech from the media should be more reasonable legal regulation,in order to protect citizens from the media freedom of speech and the healthy and orderly media environment.Firstly,this paper expounds the basic theory of freedom of speech in media,sums up the characteristics of freedom of speech in media and the necessity of legal regulation of free speech from the media by analyzing relevant cases.Secondly,in view of the existing problems of effective media-related laws and regulations,this paper puts forward some questions in the process of legal regulation of free speech in the media.Finally,we propose to improve the legal regulation of freedom of speech in China from the following four aspects by drawing on the experience of the extraterritorial legal regulation of free speech in the media.The specific is: first,perfect from the media freedom of speech legislative regulation: clear reasonable limit of the legislative principle,improve the level of the legislative body,the enactment of special media laws.Second,strengthen law enforcement: the establishment of specialized law enforcement agencies;Third,to improve the judicial system.Four,perfect from the media industry norms.
