Research On The Legal System Of The Trustee Of Charitable Trust

The trustee is one of the core parts of the charitable trust system,which has the power to manage and operate the trust property in accordance with the law.Although China's charity trust trustee system is perfect,but there are still some urgent problems to be improved.This article analyzes the present situation of the trustee in our country,and has a detailed study of the relevant institutions of the two legal departments.Combined with the practice of our country,this paper puts forward some suggestions for the selection of the trustee,the right of the trustee and the supervision system of the trustee's.This article is divided into four parts.The first part is the basic theory of charity trust in our country.The second part is the choice of charitable trust trustees.The third part is the charity trustee's rights and obligations.The fourth part is the trust system of charitable trusts.This article first describes the concept of charity trust,the characteristics and status quo.So the trustees play a important role in the charitable trusts.Because of the limitations of the natural person,it can't regard as the trustee.While charitable organizations and trust companies are trustees,they have the advantages and disadvantages.We should combine our own practice,and learn from foreign experience.Allowing charitable organizations and trust companies act as co-trustees to improve the charitable development.At the same time we should allow the double trust model exist.About the rights and obligations of the trustee,the current legislation is more focused on administration.So we should improve the legislation of the rights and obligations.We should strength the supervision of the trustee.Not only strength the trustee self-regulation,but also achieve the information communication between different departments.At the same time,we must detail the responsibilities of the supervisory and improve the disclosure system for the public.
