The Research On The Burqa Ban Of Europe

French is the first country to issue the burqa ban in the form of national legislation in Europe.Subsequently,many European countries follow to suit the country similar law in parts or cities.Not only it raised a hot wave of public opinion in other European countries,but also caused the attention of the rest of the world about Islam,terrorism,the status of women and public safety problems.In this paper,the first chapter describes the relations between Muslim and Europe,mainly from three angles that the social structure of European Muslim,the origin of European Muslim and extremism and the European Muslim women groups.First,by analyzing the population structure of the European Muslim and predict its future development trend,in order to discuss Muslim population in Europe has an impact on the social culture,values and identity.Secondly,the paper expounds the present situation of the European Muslim extremist to explain the cause of islamophobia in Europe.Finally clarify the burqa,scarf,and the veil of European Muslim women in Islam culture connotation,reveals the gender discrimination of European Muslim women.The second chapter lists the burqa ban legislation in Europe and elsewhere in the world,and further discusses the debate on the burqa ban legislation law and social relations.On the one hand,as the nationwide implementation of the burqa ban,France and Belgium's legislation have the effect of the representative to other European countries.On the other hand,understanding of Bulgaria,the Netherlands,Switzerland,Africa and countries such as Canada's attitude toward the burqa ban is helpful to fully use for reference the experience of legislation of all countries.In addition,the social problems such as religion and expression,women's rights,western values and public safety caused by the burqa ban can help lawmakers to make a better choice of value in the burqa ban's legislation process.The third chapter introduces and analyzes two judicial cases of the burqa ban,respectively is the lawsuit of a headscarf ban and the burqa ban.French court and the European court of human rights on the related litigation.The ruling methods,the legal basis and judicial reason has certain research value,has a guiding significance for the legislation of other countries work.The fourth chapter mainly discusses the enlightenment which the burqa ban of Europe brings to China.First of all,it introduces the Urumqi wearing the full-face regulations prohibited in public places in our country from the legislative background and main content.Secondly,analyzing and comparing the similarities and differences in the legislative purpose,legislative content and legal responsibility cognizance of the burqa ban between Urumqi and Europe.Finally,in order to perfect our country local legislation and refine several terms of existing basic law,the paper put forwards theoretical suggestions and emphasizes the importance of legal mechanism in harmony with the other mechanisms.
