Research On Trial Independence System In China

At the 18th session of the meeting,the General Secretary Xi Jinping pointed out:adhere to improving the system of socialism with Chinese characteristics,in order to ensure that the judiciary and the prosecution exercise judicial power independently and impartially in accordance with the law.The Communist Party of China is the vanguard of the Chinese nation and insisted on leading the development of the cause of socialism.The speech of General Secretary of the Communist Party of China(CPC)issued a strong signal of judicial reform to the outside world,which shows that judicial independence has begun to receive unprecedented attention and the pace of judicial reform has begun to accelerate.That has been an important way to upgrade the level of Socialist Rule of Law.Judicial independence is an important part of the independence of the judiciary and further it is also an important part of the socialist rule of law.In the course of the trial,the judges are susceptible to various subjective and objective factors and often can not be judged independently.Common problems such as judicial localization has an effect on Judicial trial,political and legal committee's trial and coordination cause the alienation of the case,the news media criticize the trial activities,mass petition system's alienation,NPC asked the case,the higher court ask the trial which affect the judiciary,the trial committee only trial,the court intervene the trial,Judicial trial,etc.If these issues can not be effectively resolved,it is not conducive for the jude on the independent trial of the case and is not conducive to maintain social justice and justice.In the long run,it will go further with the spirit of the 18th,in summary,comprehensively deepening the judicial system reform is imperative,but also has long way to go.This thesis is divided into three chapters to elaborate the system of independent trial.The first chapter focuses on the development process of the independent system of Chinese and foreign judges,and comprehensively recognizes the independent system of judgment from the perspective of time and space.The second chapter mainly summarizes the factors that affect the independent trial of the court,divides the influencing factors into internal and external factors,and further dissects the various influencing factors through the scientific method,divides the surface of the body,Thoroughly understand the root cause of the morbid trial.On the basis of the second chapter,the author puts forward some feasible suggestions on the independent reform of judicial reform,hoping to promote the independent trial of the court to maintain social fairness and justice.The further promote the socialist construction of the rule of law,to achieve the great rejuvenation of the Chinese nation in China dream.
