As one kind of assisted reproduction technonlogies,surrogacy can help those people who cannot have a baby by traditioal way of generation fulfill wish of childbearing.However,surrogacy is in the face of the challenges from both ethic and reality.Considering this situation,there is no law so far regulating surrogacy,only Ministry of Public Health prevent surrogacy in China by administrative regulations.Unfortunately,this mode dose not attain the results expected.On the contrary,commercial surrogacy industry has silently risen in China and has caused some disputes.Instead of ignoring this problem,surrogacy should be regulated by law in order to accommodate the demand of social development and react positively to science and technology.To construct legal regulations of surrogacy,the first step is to resolve the ethic and realistic problems.Secondly,choose the best mode after comparing three modes:autonomy by private law,regulation by the government and absolute prohibition.Thirdly,legislating ART Act which includes surrogacy regulations and buliding a professional agency.Last but not least,to operate smoothly,the Act should be in conjunction with civil law,criminal law and administrative law.
