Study On Technical Investigation System In Duty Crime In China

Technicality and confidentiality is the superiority of technical investigation.As a consequence,when conventional investigation model for crime that are committed by taking advantage of duty(hereinafter referred as crime)is faced with challenges from crimes which are more covert,intellectual and digitalized,technical investigation becomes a favorable approach for detectives.A new chapter,Technical Investigation,has been added to new version of Criminal Procedure Law,which marks that its application scale will be enlarged for future investigation process.However,indistinct and ambiguous provision demonstrates that lawmaker concerns about negative affects caused by improper use of technical investigation.In the investigation process of these crime cases,technical investigation is like a two-edged sword,which means that it will be an anti-corruption edge tool when well used while violate legal rights and interests of citizens when badly used.In this essay,relation between general investigation and technical investigation will be center topic and technical investigation will be researched combining with reform of supervision mechanism,hoping make contributions to legal system construction of technical investigation in China.In Chapter One,it mainly elaborates basic concept and characteristics of technical investigation.Connotation and nature of technical investigation in this essay will be defined and conflict and balance between technical investigation and protection for citizens' privacy right will be stated emphatically.In Chapter Two,it chiefly analyzes relation between crime and technical investigation.At first,features of crime and main body of investigation will be introduced.Subsequently,reasons why investigation faces a dilemma will be analyzed from various perspectives.Finally,adaptability between crime and technical investigation will be expounded further.In Chapter Three,technical investigation in China will be explained from its main content,building process and some issues suffered.In Chapter Four,combining with reform of national supervision mechanism,basic principles and operation modes of technical investigation used by supervision committee in all levels will be conceived in a proper way.
