Legislation On The Technical Investigation Of Duty Crimes

To give the prosecution in the job crime in the technical investigation power,is a major legislation progress.Prior to this,technical investigation has been dressed in a mysterious veil,and plant crime investigation in a considerable part of the technical investigation to take advantage of the power of the public security organs,which to some extent not only affect the efficiency of handling cases,but also detrimental to combat and punish the crime.Due to the particularity of technical investigation,its use in the investigation of job crime still needs to be further regulated and perfected by laws and regulations.There are still many problems in the practice of judicial investigation in judicial practice.In this paper,Criminal investigation in the application of technical investigation of some of the problems,combined with domestic and international experience,put forward to improve the crime of crime technology research application of the superficial vision.The paper is divided into four parts:The first part is the necessity of applying the technical investigation in the investigation of duty crime.The brief introduction of duty crime is carried out,and the concept,characteristics and types of technical investigation are expounded in detail.On the basis of analyzing the unfavorable factors of the investigation of duty crime,this paper summarizes the irreplaceable importance of technical investigation in the investigation of duty crime.The second part is about the domestic and foreign comparison of the legislation and practice of technical investigation of duty crime.Through the United Kingdom,the United States,Germany and France in the crime of criminal investigation and practice of different practices,the technical investigation of China's legislation and practice of a comprehensive analysis of the status quo.The third part is the analysis of the status quo of job crime investigation in our country.This paper mainly elaborates the concrete problems arising from the actual application of the technical investigation in the investigation of the crime of duty crime,analyzes the current situation of the technical investigation of the duty crime in our country,and tries to trace the problem.The fourth part is the suggestion of perfecting the technical investigation of duty crime in our country.Mainly from the application of plant crime technology investigation,the evidence system and the way of relief and other aspects of the idea to improve the crime investigation system.
