The owners' meeting is a common occurrence in our lives.It is an organization that divides ownership of buildings to achieve common interests.In the process of deepening and perfecting the reform of the real estate system,China faces an endless stream of real estate disputes.The existing laws cannot solve this real problem.In particular,our country law does not explicitly specify the legal nature of the owners' congress,resulting in its legal nature being paralyzed.This is also a crucial issue that needs to be resolved in the incorporation of the owners' conference.Obviously,the lack of legislation will bring about the confusion of the judicial system,which will not only increase the difficulty in resolving disputes.But will also be detrimental to the owners right to relief.This article takes the legal personification of the owner conference as the research object.First of all,this article analyzes the theoretical and practical aspects of the incorporation of the owners' conference,and clearly understands the theoretical barriers and practical difficulties encountered by the corporation.It aims to clear the obstacles for the construction of the legal person system of the owners' conference in China.Secondly,this paper studies the functional advantages of the incorporation of the owners' conference.It mainly discusses the functions and advantages of the corporation and compares the systems of some countries and regions outside the country with the owners' conventions in China.And affirms the regulations on the corporate nature of the owners' conference outside the domain.It can be seen that the incorporation trend of the owners' conference is irreversible.Finally,this article standardizes the establishment of a legal personification system for owners' conferences.We must legally confirm the corporate nature of the owners' congress,and its governance structure can draw on the relevant systems of corporate legal persons.Giving the owners the qualifications of the parties to the congress is an inevitable requirement for resolving management disputes and safeguarding the interests of the owners.We have explored the owners' conference in both theory and practice.However,the effect obtained was not significant.In the final analysis,our laws did not respond to the actual needs.Therefore,this article starts with the legal nature of the owners' meeting and tries to make reasonable choices for constructing the legal person system of the owners' conference in our country.
