The Institutional Causes Of Marriage Squeeze And The Legal Countermeasures

According to the relatively unified view of the academic community,from the 1980 s onwards,the sex ratio at birth in China began to rise continuously,which in turn gradually increased the degree of marriage squeeze in the marriage market.It has a great impact on the traditional Chinese marriage model,On the other hand,it also has an impact on the social security environment.There is a heated debate in the academic community about the causes of these phenomena.At present,it can be concluded that marriage squeeze is actually an imbalance in the sex ratio of marriageable men and women.In other words,marriage squeeze is an external manifestation of excessive sex ratio in the population structure.The imbalance of gender ratio has a great impact on the traditional marriage model,especially for the squeezed side(male squeeze in China).However,the problem of mitigating marriage squeezes by changing the traditional marriage model is currently not feasible in China because of some problems,such as public knowledge.The author believes that the reasons for the increase in the sex ratio at birth in China can be explored by adjusting the population structure,that is,from the perspective of the system,especially the influence of the birth system on the Chinese population structure.Marriage squeeze is already so serious as a social issue,and the legal system as a superstructure should respond strongly to this.Therefore,combined with relevant data and literature research,this paper makes an in-depth analysis of the factors causing the gender imbalance of population,especially the institutional factors.Based on the reflection of China's current policy,it tries to put forward a feasible system construction to ease the current and future marriage squeeze problem.From the aspect of sociology of law,this article got the conclusion that the institution has an important impact on the exacerbation of marriage squeeze.In particular,our country's birth system is an important factor in the imbalance of the gender ratio in the birth population,sequentially resulting in an imbalance in the population structure of the male and female population.On this basis,this article reflected on the current reproductive system of China,discussed its existing value,and at the same time predicted the population structure of China in the future.The future direction of the birth system is proposed in light of China's national conditions,and attempts were made to construct new related supporting legal systems and improve the current system,including aspects such as childbearing subjects,childbirth behaviors,and child support.From the perspective of sociology of law,a multi-intellectual and comprehensive social mechanism should be established at the institutional level in order to make an institutional response to the problem of marriage squeeze between more men and fewer women in China at present and in the future.
