With the rapid development of computer technology and information technology in recent years,the new economy is changing our life quietly.The transition from the traditional economy to the new-type economy has brought about a great change in the pattern of e-commerce,and also enriches the service content of the financial industry.One of the important achievements of the huge change in e-commerce model is the rise of the third party online payment.On the one hand,the rise of the third party payment institutions has effectively solved the problem of the transfer of funds in the development process of the new internet industry,such as e-commerce.In addition,in the process of third party payment development,along with the continuous upgrading,optimization and innovation of the payment business,third party online payment begins applying to more and more areas,which provide consumers with convenient and efficient service in the flow of funds,and meet the consumer demand for diversified payment services.Meanwhile,it accelerates the circulation of commodities and promotes the transaction volume as well.But on the other hand,the continuous development of the third party online payment industry has brought many problems related to the protection of consumers' rights and interests.How to protect the right of consumers' safety on the third party online payment has become the focus of these issues.Relevant laws and regulations promulgated presently in China clearly show that the legislative process in this area is still lagging behind in China.A lot of content has not been incorporated into the law,the legal level is too low,the content applicability of relevant law is not high,and the regulatory body is not coordinated.All of these just are illustrations of China's lack of effective supervision in this field.In addition,the third party online payment being a new type of service,consumers take more risks when conducting online payment than in traditional transactions,because consumers and the third party online payment platform are in a serious unequal position in information technology and economic strength.Specifically,in the process of providing services for consumers,the third party online payment platforms are still facing some legal problems,such as the protection of personal information and financial security,the appropriate handling of payment error,which urgently need to be addressed.So in the areas of the third party online payment,it is necessary and imperative to establish high rank law for protecting the right of consumer safety,coordinate supervision body in this field,and perfect specific legal system to protect consumers' personal information and financial security.This article is to study how to protect the consumer's personal information and the funds security in the third party payment.The article is divided into four parts.The first part explains the connotation of the third party online payment and the right of consumers' safety in detail,and analyzes the necessity of protecting the right of consumers' safety in the third party online payment,which lays the groundwork for the second part.The second part,focusing on the current legislative status,regulatory body and specific legal system,analyzes the problems of consumer rights in the third party online payment.The third part collects and integrates the practical experience of legislation supervision in the United States and the European Union on the basis of reference,so as to provide ideas for solving the problem of protecting the right of consumers in the third party payment in China.From the perspective of personal information security and capital safety,this part introduces the relevant legislation and supervision systems of the United States and the European Union,and the advanced experience of personal information protection,precipitation fund processing and payment error handling.Combining the experience from the United States and the European Union,the fourth part offers proposals to protect the consumers' safety rights in the third party payment in the aspects of legislative level promotion,coordination of regulatory body,perfection of specific law in the protection of personal information and funds security.
