On The Legislative Perfection Of The Piece-rate Wage System In China

The piece-rate wage system has long been in our country and has played an important role in the process of socialist construction.However,the legal protection of the piece-rate wage system has been lacking.At the same time,as the economy develops more and more,laborers are increasingly demanding their own rights and interests,but the protection of labor laws has not responded.In order to better maintain the rights of laborers under the piece-rate wage system,this paper attempts to analyze it through three parts and propose its own legislative proposals:In the first part,we first explore the piece-rate wage system and its development history,as well as the theoretical basis of the piece-rate wage system itself and the legal basis of the labor-based wage system.The second part is the legislative practice of the piece-rate wage system and its existing problems.The labor quota and the formulating power of piece-rate unit price are firmly in the hands of enterprises,and the workers do not have the right to speak.The problem of overtime under the piece-rate wage system is serious but the law has not given such overtime corresponding restrictions.The application of some supporting mechanisms also failed to meet expectations.The third section proposes solutions and legislative proposals.We will clarify the applicable conditions of the piece-rate wage system from the legislative point of view and specify in detail the procedures for formulating the labor quota.Overtime wages are applied for overtime work hours under the piece rate system.At the same time,from the institutional introduction of trade unions to strengthen collective bargaining to maintain the rights and interests of the wage-workers,and use the labor supervision system to regulate the formulation and application of labor quotas.
