With the rapid development of modern technology,such as cloud computing,large data and so on,electronic forensics have become an important means of obtaining evidence in the network cases.To this end,the newly revised criminal procedure law in 2012 provides electronic evidence as an independent type of evidence.At the same time,relying on the network security vulnerabilities,underground black industry chain trading weak regulation,under the age of the Internet network fraud is also increasingly rampant.In the face of the severe case situation,electronic forensics must play its due role.Based on the electronic evidence legal overview,existing thinking,system of electronic evidence ought to be positioning after exploring existing electronic evidence theory and foreign legislation mode,and the string of cases,using data analysis,questionnaire survey,network collection and case analysis methods in the network of public security investigators,prosecutors,judges and lawyers judicial appraisal,personnel and other relevant personnel between the electronic forensics investigation.According to the different characteristics of the stage of investigation and the stage of evidence raising,the status of electronic evidence in two stages is deeply studied,and the status and dilemma of electronic evidence in online fraud cases are combed.According to the present situation of electronic forensics system still immature to the author,discusses the development trend of electronic evidence to further improve the analysis of the lack of 2016 "Two highs and one "judicial interpretation,and puts forward its substance,in order to solve the judicial practice in the practical needs of judicial interpretation did not provide a solution to the problem,to make the electronic forensics adaptation of big data the requirements of the times,and keep pace with the times development.
