This paper discusses the controversial issues in judicial practice for the crime arranging for another person to illegally cross the national border(frontier),such as “illegally crossing” and "making arrangements".The author's purpose is objective elements of the crime should contain both " illegally crossing " and "making arrangements".The general mentality of this crime is intent.Peoples' successful " illegally crossing " under the leadership,arrangements or under the command of arrangers should be deemed the accomplished form of this crime.After organized by arrangers,if people fails to illegally cross,the crime should be regarded as attempt.People kills or injures the persons whom he arranges to illegally cross the national border(frontier)or commits other criminal acts against them or the inspectors shall be punished in accordance with the provisions on combined punishment for several crimes.Other criminal acts here to refer to those conducts which are the same serious as murder and injury.In view of the problem of the punishment for the crime arranging for another person to illegally cross the national border(frontier),the author's purpose is the unit should be included in the subject of the crime and it is nessary to further clarify the penalty range.To effectively curb illegally crossing activities,we must improve and formulate relevant laws and regulations,such as revising the Exit and Entry Administration Law,the Nationality Law,so as to make up the corresponding vacancies in administrative laws and strengthen the connection between criminal law and administration law...
