| If you want to choose a key word for the financial industry in the past three years,then“Internet + Finance” would be the first;if you choose a hot topic from “Internet + Finance”,then crowdfunding is definitely the top spot..However,the development of such a hot industry,but often be detained with illegal hats,the author found in the investigation of the reasons,there are too few legal regulations related to crowdfunding,the content is not exhaustive,and has not yet introduced a decent regulatory framework.From the final review of the “National First Crowdfunding Case” to the end of 2015,two years have passed and the crowdfunding industry still has a legal basis for judges to use.Therefore,this paper adopts a variety of methods such as comparative analysis and literature analysis to conduct systematic research on Internet crowdfunding.The purpose is to use the principles of law to find out the problems in China’s Internet crowdfunding legal regulation based on the current laws in China.,And analyzed and summed up the advanced legal regulation experience outside the domain,and finally built a complete and clear framework for the regulation of crowdfunding supervision according to their own ideas,which opened up a broad avenue for the standardization of crowdfunding.The structure of this article can be divided into two major modules.The first module is a domestic and foreign research that introduces the Internet crowdfunding.Domestic research includes basic concepts of internet crowdfunding,legal relationships in internet crowdfunding,and unresolved issues in internet crowdfunding.The foreign studies mainly summarize the law of crowdfunding in the United States,Britain,and Japan,focusing on the issues of the countries’ access and restrictions on issuers,the supervision of crowdfunding platforms,and the access and restrictions of investors.The second module is to perfect the legal regulation of internet crowdfunding from macro and micro perspectives.On the macro level,China’s Crowdfunding Regulatory Regulations are determined to be rigorous,standardized,and big data-based;assuming that the CBRC and the CSRC jointly monitor crowdfunding,with the main focus of the department’s regulations and the combination of general and special regulations.Crowdfunding industry;legally empowered crowdfunding.On the micro level,with the focus on the supervision of the Internet crowdfunding platform,the core qualifications and investment limits of crowdfunding investors and fundraisersare further refined,and the self-regulation requirements of the crowdfunding industry are also proposed. |
