Mineral resources are the foundation of our social and economic development,its development and utilization affect the relationship between economic development and national security in the coming decades.Mineral resources are important strategic significance in our country.Criminal Protection of mineral resources affect the security of our social-economic,defense industry,information industry and other fields.In order to protect reasonable development of mineral resources,and to crack down on crime of mineral resources,china criminal law and related laws both to makes rules on mineral resources.However,there are still many deficiencies in criminal legislation of mineral resources,can not punish behavior of broken mineral resources,and mineral resources are not well protected.Therefore,it is high time that improving the criminal legislation of mineral resources,punishing and preventing crime of mineral resources.The thesis by research on the criminal legislation situation of mineral resources to pointed out that the problems of Criminal Legislation of mineral resources in China.Such as lag of Legislative Idea,less criminal law offenses,the crime of illegal mining legal situation is not clear,the lack of penalties unreasonable and non-punitive measures.Analyzed by comparison to the legislation of criminal law in mineral resources with Germany,Japan,Russia,finds things that our country can use.finally,the thesis put forward advise of complete.Such as deepen the concept of sustainable development,adding new charges of mineral resources,clear legal case of illegal mining crime and improve the penalty margin,establish a multiple penalty system,add a qualifications penalty,combine penalty with non-punitive measures.
