Research On Internet Charity Legislation

Charity in China has gradually entered the “National Charity” era as internet technology developing after various forms such as government-sponsored charity,clan charity,religious charity,and folk charity,because of the double approaches of the bottom-up exploration and the top-down advance of the “Internet +” action.Based on detailed domestic and foreign literature research,the thesis improves the current concept of internet charity,and defines it as charity via online platforms established by internet technology,with comprehensive aspects of knowledge system,donation and service system,management and report system,evaluation system and other system.The thesis also concludes the features of internet charity through comparing with traditional charity to further explaining its meaning and legislature value.The purpose of theory applying is right to give meaning to practice and guide the research,thus broadening the horizon.The internet has exactly brought a new climate to Chinese charity,but having caused a series of hot events,which uncover many striking problems,for instance,uneven internet charity organizations,disordered personal behavior of turning to the internet,imperfect supervision,and weak ethic awareness.The study uses case analysis and normative analysis to reflect reasons causing the problems mentioned,and classify the current laws and regulations on internet charity to affirm its achievements as well as pointing out its inadequacies.The latter mainly manifests in the incompleteness of the internet charity legal system,the neglect of the legal status of online charities,the inadequate regulations of personal behavior of turning to the internet,and the controversial provision of the charity information platform.Finally,according to these problems mentioned above,the thesis proposes to play a leading role of the legislation in internet charity development from the macro level by following the rules of multiple governance over internet charity,leading the idea of internet charity,improving the internet charity legal system.From the micro level,as to the specific suggestions perfecting the national legislation on the internet charity,it claims lowering the entry threshold but enhancing the daily supervision of online charity organization,enacting rules to regulate personal behavior of turning to the internet,and improving the internet charity evaluation system.
