The Research On The Environmental Property System In The Construction Of Ecological Security Barrier Comprehensive Experimental Zones

Gansu Province announced the”13th Five-Year Implementation Opinions for the Construction of a National Ecological Security Barrier Comprehensive Experimental Area in Gansu Province" in 2016,actively promoted ecological construction,and coordinated the implementation of the "Opinions on Further Supporting Economic and Social Development in Gansu Province”triggered by the General Office of the State Council(Guobanfa[2010]No.29).It implements the ecological safety barrier construction with water conservation and sand control as the top priority,explores new development models that integrate economic development and ecological construction,and focuses on the construction of ecological safety barriers.In this way,it can raise the important position of Gansu in the northwest and even the whole country.As a new type of property rights,environmental property rights will not only give the entity an obligation to protect the environment but also protect the environmental rights of the subject.The owners of environmental property rights can use this right directly to prosecute the company or other environmental infringers.On the basis of environmental property rights,an increasing number of environmental lawsuits will also have their legal basis,and the judicial trials of the court will no longer be at a loss.Under the implementation of environmental property rights system,the environmental property rights could be converted into the actual rights of the subject,so as to make up for the limitations of the current environmental legislation which merely emphasize the government's environmental management,supervise of the government's administration ability according to law.The environmental property rights system is a kind of innovation of the legal system.It not only adapts to the requirements of the sustainable development of the current economic society and the actual development of the green economy,but also adapts to the legal requirements of Setting up the Ministry of Ecology and Environment and helps to resolve the problems of the absence of environmental“ownership”,it can safeguard the rights and interests of environmental rights holders,and avoid the occurrence of public environmental tragedies.This article is based on field research on ecological security barrier construction in Zhang Ye and WuWei in Gansu province.After analyzing the general theory of environmental property rights system,it elaborates the value and specific content of the construction of environmental property rights system,simultaneously analyzes the specific utility of the environmental property rights system in the construction of ecological barrier test areas in Zhang Ye and WuWei,from the perspective of the integrated ecological safety barrier testing area.The main purpose is to establish an environmental property rights linkage mechanism to promote the effective construction of an ecological safety barrier comprehensive experimental area in the process of the construction of ecological civilization.
