Electronic Data Forensics,Preservation,Reduction System Improvement

Electronic data has been listed as one of the types of legal evidence,the electronic data forensics,preservation and reduction of the relevant system is often discussed.In September 2016 by the Supreme People's court and the Supreme People's Procuratorate and the Ministry of Public Security jointly issued "on the handling of criminal cases collected some problems of extraction and examination of electronic data collection,extraction and review provisions" of the relevant electronic data are compared with the rules,but for which relates to the preservation of electronic data,electronic data evidence collection and preservation subject,electronic data forensics and security procedures,there is no clear legal provisions.In this thesis,based on the existing law of electronic data forensics,preservation,reduction the concept of distinction,analysis of existing electronic data system,it is clear that the electronic data preservation system plays a key role in the improvement of electronic data forensics,preservation and reduction system,as a breakthrough point,the author puts forward some suggestions to improve the relevant system.This thesis is divided into five chapters,chapter one is the introduction of the existing system,briefly introduces the significance of this topic,the methods and innovation points.The second chapter combs the basic meaning of electronic data forensics,preservation and reduction,and clearly defines the concept of electronic data forensics,preservation,reduction and analyzes the inherent relationship between the three.The third chapter analyzes the problems existing in our country's electronic data forensics,preservation,reduction system and practice.The fourth chapter puts forward some suggestions on the improvement of electronic data forensics,preservation and reduction system in china,the electronic data forensics,preservation,reduction the system to improve the macro thinking should be based on the improvement of electronic data security system as the core and standardize the electronic data forensics,preservation record behavior.Specific regulation is the premise of the preservation of evidence from "the existence of lost or difficult to obtain after the possibility of change into a self discovery of the right to be taken to protect measures",the main body of evidence preservation is expanded from "the people's courtand the notary organ" to "the people's court,the notary organ,the judicial authentication institution and the third party electronic data security institution",when the conflict between the system and the public interest,"the minimum damage to the public interest" into "should not infringe the interests of the public".The last chapter is proposed to build a unified Internet electronic data forensics,security system,in accordance with the requirements of the laws and regulations,combined with practical needs,to meet the actual electronic data forensics,preservation purposes.
