On one hand, the labor dispatching has the flexible market attributes, on the other hand, it has the statutory attributes that both the employers and laborers can maximize their wills within the scope of law.Labor dispatching staff return, as one of the link in the market operation, is a system that the employers can return the workers back to the labor service company in accordance with the la Together with the continuous development of the socialist market economy, a new w or agreement. It holds the attributes of maximizing the flexibility and wills as well. ? Nowadays, the staff returning system of the labor dispatching contains many problems. No matter judging from the legal basis or actual practice, it disjointed the social practice to some extent, which significantly obstructed the further development of the labor-dispatching system.. The vagueness in relevant legal provisions, the obvious randomness in practice, the vulnerability of the workers ' equity, the risk towards employers' righteous equity facing the abused lawsuits, as well as the fact of employers becoming the gathering place of risks, all these factors cause the situation that the labor dispatching staff return system is no more than a “ whit elephant”. At the same time, the great controversial lying in the serials of problems arising during the practice of labor-return pattern is particularly unfavourable towards the development of labor-dispatching system. Therefore,this paper starts from the labor dispatching staff return system and sets it as the foothold, reviewing the legislation and practice both in domestic and foreign systems, focusing the legislative and executive difficulties in our country, and puts forward opinions and suggestions towards the improvement and perfection of the labor dispatching staff return system in China.
