The formulation of the constitution of primary and middle schools is the concrete expression of the strategy of governing the country in the basic education field,by improving the construction of modern school system,to promote the rule of law and school self-management of the legal process.The formulation of the constitution is the only way to promote the healthy development of the school,is the basic condition to protect school teaching in the rule of law,is the main way to realize all teachers and students to participate in school management.Therefore,this paper delves into the formulation of the constitution of primary and middle schools,using the literature method,summarize the overall situation of the formulation of the constitution,and then use the questionnaire survey,explore the problems in the formulation of the constitution of primary and secondary schools,through interviews,explore the cause of the problem,at last,put forward the corresponding countermeasures.The paper starts from the formulation of the constitution of primary and middle schools,describes the basic situation of the formulation of the constitution of primary and middle school,some provinces fully built "a school of a constitution" of the excellent situation,begin to enter the school constitution revision work,newly-built primary schools also begin to prepare their work.At the same time,questionnaires were conducted for school staff,mainly from the primary and middle schools to develop the subject,procedures,basis,content and text of the five dimensions of feedback to the reality of the situation and the problem.The main problems in the formulation of the constitution of primary and middle schools are: subject single;the program is simplified;theory is incomplete;content is complicated;improperly expressed.What is the cause of the problem in the formulation of constitution,the author use the interview method,communicate with primary and middle school principals and teachers,found that the school has long been in a state of no constitution to run school,the principals' consciousness is weak,teachers lack the thought of democratic management;the school does not understand the formulation of constitution,lack of experience;the existence of the phenomenon of "rule by man" leads to the separation of theory and practice;The supervisor of the higher education department has insufficient support for the constitution development work,lack of oversight mechanism;The school by virtue of "their own power",always cause problems.The paper expounds the problems and their causes in the formulation of the constitution of primary and middle schools,and puts forward the countermeasures.The relevant education departments should strengthen the guidance of the constitution development work and train the subjects on a regular basis.The schools need to face up to the regulations awareness and practice;schools need to encourage teachers to participate in the formulation of the work;higher education departments to promote the selection of outstanding constitution work,improve the supervision mechanism for the development of the constitution.
