The right of teachers to exercise discipline refers to the behavior of teachers in the implementation of a certain form of sanctions on students' non-standard behavior,its purpose is to regulate the behavior of students,so that students can develop better.In the teaching activities,teachers often punish students for their irregular behavior,this discipline later evolved into the power of teachers.There is no clear legal provisions on the right of disciplinary punishment of teachers in our country,and the way to punish teachers is also vague.The primary and secondary school teachers in the practice of teaching and learning how to exercise the right to become an urgent need to solve the problem.In this paper,the use of literature,interviews and other methods,summarizes the problems existing in our country's primary and secondary school teachers' exercise of disciplinary power,analyzes the reasons behind these problems,and puts forward some corresponding countermeasures and suggestions.The introduction explains the reasons of the study,defines the related concepts,analyzes the relevant literature,and expounds the research methods and ideas.Chapter 1,combing the educational history of China and foreign countries' right of punishment of the context,introduces the teachers in Taiwan and abroad of penalty,it elaborates the teacher penalty rationality and legitimacy,discusses the necessity of the right of punishment for primary and middle school teachers.Chapter 2,this paper demonstrates the practical difficulties of the teachers in primary and secondary schools to exercise the power of punishment,performance in:there is no general standard and basis for the exercise of disciplinary power;the scope of the exercise of disciplinary authority is unknown;arbitrary punishment;poor disciplinary effect;lack of teacher protection.Chapter 3,this paper analyzes the reasons for the problems of the teachers' disciplinary power in primary and secondary schools:the provisions of the laws and regulations not perfect discipline;deviation in understanding the purpose of exercising the right of discipline;safeguard measures are not perfect;primary and secondary school students' understanding of individual rights.Chapter 4,puts forward the measures and suggestions to regulate the exercise of the right of disciplinary punishment:including the correct understanding of the purpose of primary and secondary school teachers to exercise disciplinary power;make clear the disciplinary authority of legislative teachers,so that teachers in the implementation of disciplinary law;improve the relevant rules and regulations of the school and the establishment of specialized disciplinary supervision institutions,so that the disciplinary procedures more open,transparent;the last is to improve the system of teachers' complaints,so that teachers exercise the right to punish without worries.
