The Research On The Sustainable Development Of Charitable Trust In China

With the steady growth of China's comprehensive national strength, the willingness of the community to participate in public welfare undertakings has been continuously strengthened, and the development of public welfare undertakings has got remarkable achievements. The foundation is the main driving force for the development of public welfare undertakings in our country. In recent years, due to the exposure of a series of scandals, the image of the foundation has been greatly damaged, which affects the healthy development of public welfare undertakings seriously. The advantages of the charitable trust system can make up the deficiency of the foundation system, and it is an effective way to propel the public welfare undertakings forward. However, there are some problems and difficulties in the development process of China's charitable trust, which leads the charitable trust to a protracted period of stagnation. Therefore, in order to find a good way to promote the sustainable development of charitable trust, it is necessary to carry out research.Firstly this paper elaborates the overview of charitable trust from five aspects, including the definition, origin, essential attribute, system features, and the definition of sustainable development of charitable trust. Then it introduces the classification and operation model of the charitable trust in China. Secondly, this article analyzes the current situation of charitable trust in China, and it finds out the advantages and disadvantages of the charitable trust and foundation through comparative analysis. Then it selects two representative projects for case analysis. And it describes the problems and difficulties of China's charitable trust in different aspects, such as the regulation and so on. This paper extracts the experience available for our country reference by comparing the charitable trust model in Britain, Japan and Taiwan. Finally, in order to promote China's charitable trust to achieve new breakthroughs and development and according to different problems, the paper puts forward several effective measures and suggestions:to establish and improve the register system, to clarify the responsibilities of trust supervisor, to develop the cooperation mode with the foundation and so on.
