| Price hearing system is an important system in the field of Chinese administrative decision-making, which emerges to meet the needs of public administration and scientific decision-making and face the challenges in Chinese market economy. Price hearing system has played an active role in promoting Chinese democratic and legal construction, transition of government functions, government administrative management level and other aspects since it was established and introduced into the administrative decision-making at the end of 1990’s. At present, price hearing system has been carried out extensively in China and the content of price hearing also involves the daily life of ordinary citizens in every aspect. Although price hearing system has been modified and improved constantly since the issuance of relevant documents in 1998, there are many problems due to the congenitally deficiencies in system design in the context of comprehensive ruling by law and constantly improving national governance system, questioned and criticized by the public.This paper takes the metro ticket price hearing held by Nanjing Price Bureau in 2013 as research object and analyzes the preliminary research, program formulation, composition and ratio of participants, selection methods, disclosure forms and scope, situation of this hearing and so on. Moreover, it also explores and pointed out the problems existing in the design of current price hearing system, participant selection system, moderator system, information communication system, legal force of hearing record, application scope of the hearing, etc. Through studying, it is found that these causes of these problems are concentrated on hearing program design, public decision-making system, response mechanism of decision-making sections, etc. Through comparative analysis of United States, Germany, Japan and other developed countries with sound hearing system, it is found that there are differences among these three countries in participant selection, hearing form, moderator system, legal force of hearing record and other aspects due to different social environment, but there are some useful experience and practice to be used for reference in China in the following aspects, including public participation degree, extension of program time before hearing, establishment of avoidance system, expansion of application scope, improvement of hearing judicial relief and safeguard mechanisms, etc. in combination with China’s situation and current hearing system. Chinese price hearing system can be further improved through improving public participation system, moderator system and information disclosure system of price hearing, guaranteeing legal force of price hearing and innovating price hearing forms and operating manners. |
