A Study On The Public Projects Hearing System In The PersPective Of Deliberative Demoeracy

In 1980's, Chinese Administrative Hearing System had already established and developed rapidly. And Public Project Hearing is noticed as one important part of the Administrative Hearing. It's not only the inner order that we should consider Hearing System especially in the Public Project related to people's vital interests, but also the effective way to realize the fairness, publicity and scientific of public projects.Hearing System mean to collect people's opinions, balance different interests and limit administrative power with civil rights. In other words, it has the mechanism of Deliberative Democracy and provides a platform for deliberating. So it reflects the inner value of hearing system that we discuss Public Project Hearing in the view of Deliberative Democracy, and it's a new research perspective.The Deliberative Democracy Theory emphasizes that firstly, in multivariate society, people take part in public decision freely and openly using equal rights of speak.Secondly, people consensus through dialoge, debate and consultation, at last they give a valuable direction for government decision. They all aimed to maintain and realize the public interests. Based on these, the paper analyses the negotiation type and then point out the features and development direction of Public Project Hearing which tended to pragmatic discourse. And then, the paper discusses status and problem of Public Project Hearing in example. At last, it examines the development of Public Project Hearing in China by combined Deliberative Democracy thought with Hearing System. The paper hope to have a deep thinking in development of Public Project Hearing based on Deliberative Democracy Theory, further more, give a feasible way to perfect Public Project Hearing System.
