Currently,our country is situated in the period of transformation and the functions of government also need to be adjusted,transformed and optimized in a timely fashion.Under the background of the transformation of government functions,the commercial registration system,as a key part of government management functions,must be reformed correspondingly.Although remarkable achievements have been made in current commercial registration system reform,some local governments fail to meet the requirements of the higher-level authorities in terms of understanding of policy and positioning of functions from the viewpoint of reform practice.As a result,the reform process is hold back in certain degree.Under the circumstances,this paper,from the perspective of the transformation of government functions,studies the reality of the reform of China's commercial registration system and identifies the existing problems,so as to find a model complementary with the commercial registration system.By analyzing the requirements for commercial registration system providing by government's change from the “all-round government” to the “service-oriented government”,and the research on pilot reform areas and the implementation of reform in China,the author has found the following problems of the reform of the commercial registration system: first,relevant legislation is scattered and the amendment process is slow;second,the local reform is inconsistent and lacks unified support;third,there are difficulties and obstacles to coordination among governmental departments;fourth,the slow pace of the construction of supporting system.The causes of the above problems include: First,historical reasons,namely the implications of the planned economy.Second,the conflict of interests among different organs of power hinders the deepening of the reform to a certain extent;third,the reform of administrative law enforcement has a certain impact;fourth,the lack of mature experience for reference.In view of these problems,this paper draws lessons from the advanced experience of foreign countries and other areas,and proposes recommendations and countermeasures in terms of improvement of system design,supporting measures and institutional functions.
