Research On Privacy Protection Of Cookie Technology

The rapid development of information technology for privacy protection proposed many unprecedented problems. On World Consumer Right's Day, 2013, CCTV's annual gala let users know the Cookie, and the Cookie technology is the important technical method to affect the privacy of network users. Cookie technology improves the network user experience, promotes the development of the Internet industry, but also there is the possibility of harm to users' privacy. How to use Cookie technology to effectively regulate the behavior of the violation of user privacy becomes a problem that needs to be settled.At present, in view of the Cookie privacy security issues, the vast majority of research is from the technical perspective, but research from the perspective of jurisprudence is not enough. In this paper, the integrated use of comparative law, empirical method and historical analysis, introduces the origin and development of Cookie technology, combined with the connotation of personal privacy and personal information, and grasped the characteristics and differences of theory, analysis the Cookie technology possible defects in personal information protection based on China's current deal with Cookie privacy issues present situation analysis, contrast to refer to the practice of the European Union, points out that privacy problems urgently needed to regulate the Cookie technology in China, and need to give full play to the role of self-discipline and strengthen the protection consciousness, puts forward some concrete measures.This article is divided into five chapters. The first chapter is about the use of cookie in the era of Internet. In this chapter it is firstly introduced the origin and type of Cookie technology, then expounded cookies technology playing a huge role in the era of Internet, and finally analyzed the technical violation of user privacy using cookie. The second chapter is about the privacy and personal information. From the theoretical level, it is introduced in this chapter analyzing the concept of privacy and the right of privacy, and the relationship among privacy, the personal data(information) and personal information. The third chapter is to cope with the current situation of the Cookie privacy in our country. The author firstly analyzes the regulations about cookies, and then points out the problems of China's current legislation regulation, finally introduce the present situation of China's industry self-discipline. The fourth chapter is the EU's response to the status quo of Cookie privacy including introduction of the EU regulation about Cookie and the relevant institutions, analysis of focal point question faced by the European Union to regulate the Cookie. The fifth chapter is the countermeasures and suggestions for the Cookie privacy problem. Based on the theoretical framework of the previous chapter, after rethink how to deal with the privacy about the Cookie in China, put forward we need to deal with the privacy about Cookie from three levels, the country, the industry and the individual, and provides some suggestions on specific measures.
